This Indenture    Made this tenth                                   

Day of June in the year of our Lord  One Thousand

eight hundred and fifty six, Between  John F. Devereux

of the County of Cattaraugus  Francis Kernan of the

City of Utica and State of New York as Executors of

the Last Will and Testament of Nicholas Devereux

deceased late of the City of Utica aforesaid, Mary D.

Devereux relict of the said deceased, Mary B. Devereux,

Thomas R. Devereux, John F. Devereux and Ellen

M. his wife,  Francis Kernan and Hannah D. his

wife, Richard William Lalor and Cornelia D. his

wife, Heirs and Devisees of the said Nicholas

Devereux deceased  Party of the First Part and

Mary D. Devereux, John F. Devereux, Thomas R.

Devereux (aforesaid) and John Timon of the City of

Buffalo and Pamfilo De Magliano of the County

of Cattaraugus aforesaid, Trustees of the “St.

Francis’ Missionary and Benevolent Society

incorporated in the Village of Allegany in the

County of Cattaraugus and State of New York,

Party of the Second Part.  Witnesseth:

That the said Party of the First Part, for and in

Consideration of the Sum of one dollar to them


eight hundred and fifty six,   Between  John F. Devereux

of the County of Cattaraugus  Francis Kernan of the

City of Utica and State of New York as Executors of

the Last Will and Testament of Nicholas Devereux deceased late of the City of Utica aforesaid, Mary D.

Devereux relict of the said deceased, Mary B. Devereux,

Thomas R. Devereux, John F. Devereux and Ellen

M. his wife, Francis Kernan and Hannah D. his

wife, Richard William Lalor and Cornelia D. his

wife, Heirs and Devisees of the said Nicholas

Devereux deceased Party of the First Part and

Mary D. Devereux, John F. Devereux, Thomas R.

Devereux (aforesaid) and John Timon of the City of

Buffalo and Pamfilo De Magliano of the County

of Cattaraugus aforesaid, Trustees of the “St.

Francis’ Missionary and Benevolent Society

incorporated in the Village of Allegany in the

County of Cattaraugus and State of New York,

Party of the Second Part,    Witnesseth:

  That the said Party of the First Part, for and in

consideration of the Sum of one dollar to them

in hand paid, by the said Party of the Second Part,

the receipt whereof is hereby acknowledged,  Have

granted, bargained, sold released and conveyed,

  And by These Presents, do grant bargain sell

and convey unto the said Party of the Second Part


their Successors and Assigns forever.  All  that Certain

Tract of Land situate lying and being in the

County of Cattaraugus and State of New York, being

part or parcel of a certain Township, which on a Map

or Survey of divers Tracts or Townships of Land in the

Western part of the State of New York made for the

Holland Land Company by Joseph Ellicott, Surveyor

is distinguished by Township number One, in the

Fifth Range of said Townships, and which said Tract

of Land on a Certain other Map or Survey of part of

said Township into lots, made for the Allegany

City Company, by T.S. Brown Surveyor, and filed

in the Office of the Clerk of Cattaraugus County, said

Tract is distinguished by Lots numbers Seven and

Eight, the North Part and South East part of Lot

Number Nine, and the North East Part of Lot

Number Ten, according to Brown’s Survey and

map aforesaid – The said Lots and parts of Lots

being   Rounded   (together) as follows – To wit;

  Beginning at the intersecting point in the Center

of the Highway leading from Allegany Village to Olean,

and the Center of the New York and Erie Railroad track at the 

crossing of said Roads in the Village of Allegany; Thence northwesterly

along the center of said highway North forty seven and one 

fourth degrees West twenty six chains eight links; Thence

North on a line parallel with the East bounds of said lot number seven

four chains to a point in the line between Townships number One 

and Two in said Range (which point on a

Allegany River; Thence Northerly Westerly along the 

North bank of said river to a point in a line parallel

with the East bounds of said lot number Seven at the distance

of twenty four chains twenty one links west therefrom; 

thence North on a line parallel to the East bounds of

said lot number seven as aforesaid fifty-five chains

Eighty six links to a point in the center of said New York

and Erie Railroad; Thence Easterly along the centre of 

said Railroad to the place of beginning: Containing in all

Two Hundred Fourteen 80/100 acres according to the

plan laid down in the margin hereof--Saving and excepting

however, from the above Grant, and within the

Boundaries thereof, All, and singular, all that certain

Triangular piece of parcel of Land lying between the

said New York and Erie Railroad, and the said Highway leading 

from Allegany Village to Olean being and containing Fourteen

and Eighty hundreths acres--more or less, the same being and 

hereby is expressly reserved to the party of the first part;

 saving and excepting also to the New York and Erie Rail Road

Company All lands, Rights of Way, any and all privileges

heretofore conveyed or assured by the said Nicolas

Deveraux in his lifetime unto said Company--saving and

excepting also a Right of Way along the bank of said 

Allegany river, for a towpath, and also the right to flow

said bank; Excepting all Timber and rights pertaining to same, 

by virtue of a timber contract heretofore made with

[A.] [P.]  Stetson & Co.   [   ]   the Residue of said

Tract (after such Reservations and Exceptions)

more or less,  Together with the Appurtenances,

And All the Estate, Right, Title and Interest

wherein, of the said party of the first part, [as such]

Executors, Heirs and Divisees, unto the said party

of the Second part  To Have and To Hold

the above mentioned and described [premises ]

unto the said party of the Second part, their

Successors and Assigns, [    ]

to their own proper use, benefit and behoof [forever]

with all and singular, the hereditaments and of

purtenances thereunto belonging, or in any will

appertaining.

  In Testimony whereof, the said parties of

the First Part have hereunto set their hands and

seals the day and year first above written
